A proposed conditional use permit for property at 120 Village Circle was the focus of one of several public hearings at the Nov. 5 meeting of the Senoia Mayor and Council.
On Oct. 12, Joe Pedecino of Legacy Media submitted an application for a conditional use permit to construct a 100-foot-tall communications tower at 120 Village Circle to transmit the radio signal for station 92.5 FM “The Bear.” At a recent city Planning Commission meeting, the tower height was amended to 120 feet.
The Planning Commission recommended a denial of the request because:
— The owner of the property did not resolve the issues raised by Mr. Lindsey (property owner) regarding the covenants. These issues shall be resolved.
— The applicant amended the application from a 100-foot tower to a 120-foot tower. The city needs to notify the affected residents of the change.
— The applicant did not provide a site plan showing where the tower was to be located. Site plan shall show required fall zone and crumple zone.
— The ordinance requires a fall zone equal to that of the height of the tower. This could not be achieved on the property.
— Design specifications were not provided. This should have included an engineering report verifying any proposed crumple zone.
— The additional 40-foot buffer required along adjacent residential properties could not be provided on subject property.
— Big T airport was not notified by the applicant.
At Monday’s meeting, Pedecino addressed the council and explained how he had — or planned to — meet all concerns previously mentioned.
The variance was granted by the council with the conditions that: 1. landscaping be installed to beautify a fence surrounding the foundation of the tower; 2. the tower can’t be used by anyone other than the radio station or the city of Senoia and 3. if operation of the radio stations ceases, the tower will be removed.
Pedecino agreed to all those conditions.
In other business:
• A first reading was held of an amendment to the city’s Historic Preservation Ordinance. The proposed changes are intended to make the ordinance conform to the expectations of the State Historic Preservation Organization in order to achieve Qualified Local Government Status.
The changes would, according to documents from the city:
1. Place the approval of Certificates of Appropriateness in the hands of the Historic Preservation Commission, not the mayor and council.
2. Establish an administrative by-pass procedure, and
3. Place approval of the guidelines in the hands of the mayor and council.
The first reading was unanimously approved.
• Approved was an expenditure of up to $7,600 to evaluate sub-soil conditions at the Leroy Johnson Park to determine the extent of a former landfill on the property.
• Approved was necessary repair and replacement of the Luther Bailey Road bridge. On June 22, 2012, the city of Senoia received a letter from Bill Cawthorne, Coweta County Public Works director, indicating that the bridge on Luther Bailey Road had been downgraded by GDOT.
GDOT’s report indicated several deficiencies with the bridge, including section loss of the superstructure and deterioration of the substructure. The letter further stated that it would be necessary to repost the weight limits on the bridge. Cawthorne offered to complete the reposting as required. The city agreed and it was reposted in July. GDOT recommended that the bridge is upgraded to a point where posting is not necessary.
The bridge had been declared incapable of carrying loads larger than four tons, which includes school buses, which are now rerouted on safer streets. The mayor and council approved necessary work at a cost not to exceed $115,000. Making the repairs was stated as a high priority.
