Jobs, illegal immigration, HOPE money on agenda

The budget will most assuredly be the biggest issue of the 2011 session of the Georgia General Assembly, but it definitely won't be the only one.

For State Sen. Mitch Seabaugh, R-Sharpsburg, the big three issues are jobs, illegal immigration and the HOPE scholarship.

Jobs is job one, of course.

"We are all very sensitive that we have to do everything we can at the state level to help promote the creation of jobs and also an environment that keeps jobs in Georgia," Seabaugh said.

Some of those things include development tax incentives and "changes to certain regulations that are prohibitive to business," he said.

Of course, "the government does not create jobs," Seabaugh said. "We can only influence the environment -- in which either jobs are created or we restrict jobs."

The federal government has a more direct impact on decisions by companies to create jobs, with uncertainty in regard to cap and trade, tax breaks, and the insurance mandates, Seabaugh said.

Regardless, "we have to do all that we can at the state level to be able to help industries to create jobs and keep jobs in Georgia," he said.

That includes working to support existing businesses, including small businesses.

"When you're talking about government regulation and tax incentives, we definitely have in mind the small business -- the business with five or 10 employees. Those are where the majority of jobs are, that is where the biggest opportunity for jobs creation is," Seabaugh said. "It's not just in attracting large companies. We understand that."

Perhaps there are things business owners have to spend time on dealing with state agencies when they could be using that time and effort to create new markets and opportunities, and expand their business, Seabaugh said.

"Some of the paperwork that small companies have to deal with" is quite onerous and "things like that are the types of things we need to cut out," Seabaugh said.

Seabaugh added that he wants to hear from constituents on things they feel help or harm job creation and growth.

The Special Committee on Tax Reform and Fairness for Georgians, appointed last year, will be making its recommendations soon. Those ideas "could have very significant impacts on job creation and our budget," he said.

The HOPE scholarship is a big concern this year because the program is starting to dip into its reserves to meet obligations. There already have been cuts to the book allowances, and there have been discussions of possibly raising the grade point average needed to qualify for HOPE, or slashing benefits in other ways.

Seabaugh said none of these problems would exist if the Georgia Lottery Corporation was doing what it is supposed to do.

He wants to make sure people understand that the Georgia Lottery Corporation is a separate legal entity, and the legislature doesn't vote on their budget or the corporation members and "we cannot tell them how to operate," Seabaugh said.

When the lottery was first created, Seabaugh said, a target was set that the lottery corporation should be putting 35 cents of every dollar it makes on HOPE.

"The lottery corporation has failed to hit those targets," Seabaugh said.

If HOPE was getting the 35 percent it is supposed to get, "we would not have the challenge we have with HOPE right now," Seabaugh said.

"We've got to work on, number one, finding ways to get the lottery corporation to do what they are supposed to do," he said.

Seabaugh said he has been working for three years on legislation to bring more accountability to the lottery corporation, but hasn't been able to get anything to the Senate floor for a vote.

"I think our new governor is going to be very supportive of working in this area, and I'm looking forward to working with the administration in strengthening HOPE for future generations," Seabaugh said.

Barring that, Seabaugh feels that, when the HOPE reserve gets down to a certain level, "then we need to have a trigger" whereby, whatever is brought in by HOPE is divided by the number of HOPE recipients and "that is what the scholarship amount will be for the year."

Then there is illegal immigration, an issue that has come to the forefront as more Georgians are unable to find work.

A joint House and Senate committee has been working to gather input and craft recommendations for new legislation dealing with illegal immigration, which should be coming out with recommendations soon.

The General Assembly passed Senate Bill 529, the Georgia Security and Immigration Compliance Act, in 2006.

That law requires any public or tax-payer funded entity to require affidavits from all contractors and general contractors doing public projects.

In those affidavits, contractors don't swear that they don't employ illegal immigrants. Instead, they swear that they use the E-Verify system to make sure any newly-hired employees are eligible to work in the U.S.

The way the law is currently written, a contractor could sign up for E-Verify the day before bidding on a contract, and could have plenty of illegal employees, as long as the contractor doesn't hire additional illegals after signing up for the program.

Refining and strengthening that law has been one of the ideas discussed by the committee, as has increasing programs whereby law enforcement officials check the immigration status of those arrested for crimes, and detain those in the country illegally.

There has also been discussion of Georgia implementing an "Arizona-style" law that requires law enforcement officers to approach and question anyone they feel might be in the country illegally.

"A lot of times... after you pass the law, the issue is the enforcement of it," Seabaugh said. "I have been here long enough to know that, no matter how hard you try and have a very tight law, there are ways around it," he said. "That is why you have to revisit it and make sure that those who are finding loopholes cannot continue to... violate the spirit of the law."

Those are the major issues Seabaugh sees for the 2011 session, but "there is always a surprise issue that comes up," he said.

"We don't know what it is yet, but there will be a surprise issue that rears its head -- that will captivate not only the members of the Georgia General Assembly but Georgia itself," Seabaugh said.

Last session, that issue was Gov. Sonny Perdue's hospital "bed tax."

Seabaugh said he hears from his constituents on these and other issues, and it's his job to solicit input from those he represents.

I am a Manager, and when I was out of work I could not get a job with a local in Newnan business because I did not speak spanish. Later I was hired in another position and met my spanish speaking competition for the job. I was far more qualified for the job. I just had a language barrier due to all the illegal imigrants in the place.

Political parties aren't football teams - it's not a game - it is serious business. Deal, a career politician and Democrat, until Georgia's voters switiched parties, then, overnight, he morphed into a Republican. If Georgia's voters switch back before the next election, he will morph back. D or R, a crook is a crook. Georgia's voters are two for two.

I'm sure there are thousands of out of work Georgians who would be thrilled to have a job, even if it is digging ditches for minimum wage. But most illegals are working in landscaping, Streetscapes work,road building - these are good jobs that pay well.
For some reason there is this misconception that everybody who is out of work is getting unemployment - that is not the case, at all. Independent contractors, people paid with 1099s, people who weren't on their job long enough - DO NOT GET UNEMPLOYMENT
A friend just got a temp job for minimum wage and he is thrilled - for many people, $7.25 an hour would be a God send. So enough of this ridiculous talk about how nobody wants the jobs illegals do

As a US Rep., Deal represented the two towns with the highest concentration of illegal aliens in the Georgia(Dalton and Gainesville)- all the while, talking out of both sides of his mouth - while he railed on illegal aliens to the voters, with a wink and a nod to his biggest contributors,their employers, they continued hiring 10s of thousands of them.

One of the main reasons that Georgia voters supported Nathan Deal was his tough stance on illegal immigration - he immediately betrayed the voters, to favor a handful of fatcat employers, who benefit from taxpayer subsidized, cheap labor.

@ Here's Your Answer...so you say who wants to work for $7.25 per hour? You are saying that someone who has been out of work for months, who is living off of unemployment from taxes, that is relying on the health department for cold medication, shouldn't have to work for $7.25 and be taxed until the economy recovers? So it's okay to have ilegals doing it so the Americans don't have to belittle themselves?

Who wants to work for 7.25 an hour and be taxed with no benefits. Nobody but the illigal immigrants, cause they don't have to pay taxes, so therefore they make more. I think the ones with a family that is married to a U.S. Citizen should be able to get legal here, and the ones that don't plan to stay here, make them go back to where ever they are from.

We do not know what kind of criminals that are roaming from state to state with multiple names, SS#. Who could be rapist, murderers, Drug smugglers. Being U.S. born, If I break the law, I am held accountable. All they have to do is move to another state or county and buy new id.. 287-G allows local law enforcement to link with INS to screen for wanted criminals or people with INS holds. If they have a hold on them or are a wanted criminal, INS comes to get them. Quote from Gainesville times 4-10 "Two years after sheriff’s officials started an immigration enforcement program known as 287(g), some 2,000 people arrested in Hall County while in the country illegally have been turned over to federal officials for possible deportation." I would say we have a greater problem than jobs. If crime is not enough reason to be against illigals, I can give you more. Please google 287-G.

Let's back it up to the county level again. 287-G. It is available to every county in Georgia and most counties turn a blind eye to it. Every county that has the 287-G program have the lowest number of illigal immigrants.

I am surprised when people post that illegals are taking away jobs. Though I do not support illegals, I hardly think they are stealing jobs. I am willing to bet that if you offer someone their mid 20's a job, for $7.25, digging ditches, you'd hear crickets. Let's find another reason to be against it, if we must.

The vast majority of illegals in Georgia and across America have no way to become legal residents in America. You either have to have immediate family with permanent legal status or immediate family that are U.S. Citizens. They can file a petition to immigrate the relative. Most illegal aliens don't have family lawfully here, so I say get rid of them through attrition. Quit hiring landscapers and other contractors that use illegals on their crews. Make them prove they used E Verify system. There are very few legal aliens that would work mowing lawns or digging ditches, because the wages are too low. Americans and legal aliens have to pay for cars, insurance, licenses etc... So they need to earn more money.
Georgia should hire ona contractual basis, retired federal immigration special agents to spot check jobs that are being done with local, state, and federal funding. They won't drain the state by collecting expensive benefits or retirement, because they already have their benefits and retirement. They wouldn't require training.

As long as there are hungry and jobless Americans that want to work illegals should be required to go through the process to become legal or be removed to their own countries. I've worked around several, all pretty nice guys, but, they are proud that they pay for nothing of importance and send several hundred dollars a week back to Mexico. It will NEVER feel acceptable.

I am a retired Atlanta police officer and I can remember having problems with illegal immigrant 30 years ago. We would have these people arrested and in custody and having NO idea what their true name was and when the Federal government was notified we were told that this was none of our bussiness, so this problem is quite old and not something that has just appeared.

We can never be defined as a "nation of laws" as long as one illegal alien is allowed to stay here. Americans are without jobs because this, and past, administrations have encouraged the invasion across our southern border for votes and cheap labor. How sad to see our government sell us out for those who laugh at our laws.

E-Verify barely works and has loopholes in it.
IF they use the same systen unemployeement uses that would be the end of illegal immigration as they cannot get unemployeement benefits because they have to prove that they are the person that the Social security number belongs to.
Georgians also miss out on millions of tax dollars because of worker misclassification.
That is where every worker for a company gets a 1099 form instead of a W-2 form
New york made up 4 billion dollars in one year by enforcement of the existing laws.
Stop illegal 1099 use Mitch!!!

It should be obvious to everyone by now. Foreigners who have no respect for our laws are just out for themselves. They leech of U.S. taxpayers (welfare checks for their anchor babies, free health care in our emergency rooms and free educations) and send billions to their own country each year. Time to enforce our laws!

Maybe if the lottery employees were'nt getting such huge bonuses, there would be more money to add to the HOPE funding. I see no reason why they should receive 6-figure bonuses when they are not contributing the 35% that was intended and agreed upon.

How about FORCING companies to sign up with the E-verify and then ENFORCING any and all fines and imprisonment for employing illegals? We have got to force ALL illegals out before we can get out of this recession and then we need to KEEP them out and force them to come back LEGALLY.
