County faces lawsuit for denying church permit

A federal lawsuit has been filed over Coweta County's denial of a permit for a proposed church on Buddy West Road.

The Alliance Defense Fund filed suit in federal court Friday on behalf of All Souls Church of God in Christ.

On Jan. 19, 2010, the Coweta County Board of Commissioners voted 3-2 to deny a conditional use permit for the proposed church at 401 Buddy West Road in north Coweta.

The county's planning department had recommended approval of the permit for the five-acre tract, with conditions.

But residents in the area appeared at the public hearing before the Coweta County Board of Zoning Appeals to oppose the church permit. The major reason residents gave for opposing the church was the traffic impact. There were also worries the church would negatively impact the "rural feel" of the area.

All Souls wants to build an 8,400-square-foot church with seating for 299 members. The 70-space parking lot would be set back about 150 feet from the roadway, with the church behind it. An old shop building currently sits where the parking lot would be. A house near the front of the property would be torn down. The church purchased the property in June 2008.

The BZA unanimously voted to recommend denial.

In addition to traffic and quality of life concerns, neighbors said they were worried about storm water management, the glare from lights, and the effect the church's septic tank might have on wells -- all items addressed either through proposed zoning conditions or county ordinances.

Then Third District Commissioner Randolph Collins made a motion to deny the permit. Voting in favor were Collins, Paul Poole and Tim Lassetter.

Commissioners Rodney Brooks and Al Smith voted against denial.

The church reapplied for the permit soon afterward but later withdrew the application.

On May 19, 2010, Coweta County was served notice of an investigation by the U.S. Department of Justice into the denial.

The investigation was launched to determine whether Coweta County had violated the Religious Land Use and Institutionalized Persons Act of 2000.

Erik Stanley, senior legal counsel for The Alliance Defense Fund, said he doesn't think there has been a formal decision rendered by the DOJ.

"The Department of Justice frequently takes quite a bit of time to investigate," Stanley said. "All Souls just didn't have the time to wait around."

Stanley said that ADF was contacted by All Souls.

According to its website, The Alliance Defense Fund is a legal alliance of Christian attorneys and like-minded organizations formed to defend "the right of people to freely live out their faith." All legal services are provided free of charge.

"One of the major reasons ADF got involved is because it is always very concerned when a church asks for zoning permission to build a church, and the professional zoning staff of the county recommends approval," but the church is denied anyway, Stanley said.

The planning staff "doesn't see any objective reason why the church can't be there, and then the county just denies zoning approval for no apparent reason," he said.

"It makes it seem as if there is something else going on, either political pressure or some other kind of arbitrary reason for the zoning denial," Stanley said.

"That is precisely why Congress" passed the Religious Land Use and Institutionalized Persons Act, he said, "to protect churches against arbitrary and subjective zoning decisions like this."

"I don't think the county will be able to point to any objective reason All Souls was denied," Stanley said.

Stanley said that, while the RLUIPA claims are the primary claims, "there are some other constitutional claims that we have made as well," in regard to the standards the county uses to make zoning determinations. "Mainly that those standards just allow for arbitrary and subjective decisions that can be unlawful," he said.

Coweta County's zoning ordinance allows churches to be located in almost any zoning district, as long as they have a conditional use permit.

Churches can locate by right -- that is, without a conditional use permit -- in the Office and Institutional District, and certain commercial districts, including Commercial Limited Services if the church is under 5,000 square feet, and C-6, Commercial Minor Shopping, if the church is under 25,000 square feet, according to the county's zoning ordinance.

Many churches in Coweta, however, are located in areas zoned Rural Conservation or some other residential zoning.

Stanley said ADF has reviewed the zoning code.

"The main thing that we are focusing on with this suit is protecting the church and other churches from being subjected to arbitrary zoning decisions -- because that is what happened here," he said. "It is difficult to understand why All Souls was denied zoning approval to locate on this property when every objective criteria used to decide these issues pointed in favor of granting their application."

All Souls wasn't the only African-American church denied a permit by Coweta County in 2010.

In June, the commissioners voted 3-1 to deny a conditional use permit for Holiness is the Way Ministries.

The church had requested a permit to build on 10 acres on Ga. Hwy. 16 East, near Old Highway 16.

Holiness is the Way had planned to build a 24,000-square-foot building with an 8,345-square-foot sanctuary and a 10,000-square-foot gymnasium.

At the public hearing, the commissioners heard from residents of Short Road who were opposed to the church. The back of the church property touched Short Road, but the church itself would have been located approximately 650 feet from Short Road.

One Short Road resident said the church "doesn't need to be sitting among residential houses."

Unlike All Souls, Holiness is the Way had not yet purchased the property it sought to locate on. The pastor told the commissioners he was willing to not build the gym as long as he could get the church.

Then-Commission Chairman Paul Poole made the motion for denial. Lassetter and Collins also voted in favor of denial, while Brooks was opposed. Al Smith was not in attendance at that meeting.

@ND. It is "Christians" like you that make ME sick. Stand on your box and downgrade others just because a church was denied. Sometimes we just don't need another church. Why are you not extending your Christian hand and offering an invitation to your church so that these people may worship while their situation is being resolved? No new churches unless they are filled by the immediate neighborhood.

So, if I'm understanding correctly, the County Commission has voted to appease the residents of Buddy West Rd at the expense of all of the other Coweta County residents paying for a legal defense against a FEDERAL lawsuit??? It's going to be really interesting to see the price tag on this one.

Genius Commission indeed, for acting in the fullest spirit of its duties to every citizen of Coweta. Where is the church getting its parishioners, if not from its very vocal neighbors, who want no part of it? If the church cannot respect the wishes of its neighbors, it deserves neither courtesy from them, nor favor from the officials they elect.

if the people that live in the area don't want it then what's the big deal? Build in an urban area so no objections could be raised. I'd normally be all for it, but the sheer size of the church is what concerns me. It would overwhelm the infrastructure.

All Souls Should be able to build where ever pleave these people followed all steps and still were denied . On the other hand counsil of newnan DID NOT follow the constitution they built.. With this said it is okay to break your own laws be fair and let god grow.

It is a sad state of mind our elected officials jave. wasting even more of our money on idiotic decisions. I enjoyed the comments before stating the local residents were concerned over traffic and effects on their lives. What do they think is going to happen as the world keeps spinning and change comes? I hope the Commisioners wake up and stop making horrible decisions.

Doesn't the church own that property? They bring nothing but good to your community and you are throwing fits! I've been to the public hearing and I am white and totally disagree with your reasoning for not wanting the church there. Within 1 mile of my home there are 5 different denomination churches and I could not ask for better neighbors! I watch out for the churches and when we go out of town all I have to do is make a few phone calls and I know my home is in good hands. What can be so bad about the teaches of our heavenly Father in your neighborhood? Oh I forgot, it causes traffic and prevents star gazing... You folks on Buddy West need to stop and ask yourself "what would Jesus do?"

I agree with the church on this one. They met all the the zoning requirements, and were even willing to conceed on a few fronts, and were approved by the Planning department. Then here comes the genius Commission to rescue, and causes the county to get into another lawsuit, not to mention a federal investigation by the Dept. of Justice.... Good grief.

For the people who do not live in this area, you need not comment! I do live in this area and what are my rights? The type of building they want to build does not belong on this residential road; especially, the people who want to build it. My exprerience with the members has not been very positive; which has truely concerned me. If they are this rude and threatening, what kind of neighbor will they be to me and my family??

But the commissioners listened to what the people that lived in the area wanted. You can not complain that they listened to the people in this case and now the county is getting sued over it, they did want the majority of citizens in the area wanted. When they don't listen, everyone complains and when they do listen everyone complains. Bottom line is that our zoning ordinances need to be changed and Tolleson needs to stop approving EVERYTHING THAT WANTS TO COME INTO THE COUNTY. If Tolleson would have recommended that they deny the request, then the county would win in court. They will loose this fight, but the true leadership will appear when a commissioner asks to rewrite the zoning ordinances and fire Tolleson. As long as they allow Conditional Special Use Permits, the churches will always win. I don't think this is a race issue, I don't want any type of church next to my house. They are commercial buildings, why allow them to build in a residential area?

What kind of example are we setting??? Not a good one! We do not need another Church in Coweta Co. Why don't you go to one of the 100 churches we already have! Now this is great Our Taxes will definitely go up now just to pay for someone not getting their way!!! BOO HOO!!
Who are you to tell somewhere what to do? I am so sick of Coweta County residents complaining, and griping about non important issues. Adding another church to Buddy West isn't going to affect it, I drive this road daily and I do believe another church sits on Buddy West as well. When is the County going to realize that these non important issues are going to catch up with them, and it's killing the tax payers hard earned money? I am betting the church wins this one (Hint, Hint...Starship won) Please for crying out loud, Coweta County grow up and pay attention to the IMPORTANT ISSUES were facing.

we do not need another NEW church... the church they are wanting to build is huge.. way to big for our little area. too much trafic for a already busy road. you purchased the land and did not do you research. not our fault - sell and find another location. color not a factor. just dont want another chuch in my back yard. we spoke up and the city lisened.

Another church lawsuit... another thrown "race card"...
Here's an idea... allow them to build as long as they pay for all of the affected costs associated with it... That means the water requirements (it will need upgraded in the area), city sewage (not a sceptic tank!!), Traffic impact, now and future additional traffic, emergency services, and pay the home owners if/when it drops the valves of our property.

Funny how the people are for church, but only for "their" kind of church. Too ignorant. Also, just because there are existing churches doesn't mean people want to be a part of them. That would be like saying In and Out burgers could not setup, cause we have enough fast food joints already. I want a little option...

Why not set your church up at the VACANT Church property, on Hiway 29? Everything is already built, everything is already in place, bet you could get the VACANT property for a good price - doesn't that make sense to use what's already there?
And as the other post said, there are 100 existing churches you could join up with, instead of starting from scratch.

Coweta County has another prominent name - Defendant. One of the most sued entities in Coweta County. Church will win bigger than Secretariat. And all the while, another 25,000 deductible that will be paid plus costs.
